Articulation Agreement between the University of Dundee, UK and Nanjing Forestry University, the People’s Republic of China concerning collaborating on the 4th year undergraduate programmes and taught MSc degrees in the School of Computing
Parties to the agreement
1. The parties to this agreement are:
a. The University of Dundee, Nethergate, Dundee, DD1 4HN,
b. Nanjing Forestry University, Longpan road, No. 159,Nanjing 210037,
The nature of the agreement
2. UoD and NFU agree to co-operate in the development of an articulation arrangement through which students of College ofInformation Science and Technology, NFU who achieve the requirements stated in paragraphs 4 below will be eligible for entry to UoD’s fourth year of undergraduate courses and MSc courses in the School of Computing. This particular collaborative programme consists of two parts:
Part A: qualified NFU 3rd year students in a computing related or suitable subject will continue their 4th year of undergraduate studies at UoD. After successfully completing all the requirements of both NFU and UoD under this programme, the students will graduate with an NFU bachelor degree and receive a university certificate of performance by UoD. Students who failed any of the UoD modules will be referred to the NFU programme review board at the end of the year for a final decision of the degree award;
Part B: NFU students who have successfully completed their final year programme at UoD will be eligible for entry to the relevant UoD’s MSc degrees in the School of Computing for a period of one year. The MSc degree will be awarded by the UoD.

(programmes with* start in January)
3. Development of the articulation arrangement will be subject to the general conditions set-out in paragraphs 5 to 28 below.
Admission requirements and numbers of students
(i) Stage one: Under the proposed articulation arrangement, the UoD will offer admission to level 4 non-graduating programme in the School of Computing to students from NFU who have:
a. Successfully completed the first 3 years of undergraduate study in a computing related subject and achieved an academic performance within the top 50% of their class during the first 3 years;
b. Achieved a standard in English language that is acceptable to the UoD (e.g. minimum IELTS 6.0, Cambridge Certificate (C or above), TOEFL (Minimum IB92, CB237, PB580))
(ii). Stage two: Under the proposed articulation arrangement, the UoD will offer admission to the MSc degrees in the School of Computing, to students from NFU who have completed part A study stated in paragraphs 2 at Dundee and obtained a Bachelor degree from NFU at an appropriate class in a subject that is appropriate for entry to the MSc courses in the UoD’s School of Computing.
The number of students to be admitted each year by the UoD will be agreed in advance with NFU. A cohort of students not exceeding this number will be entered for the course of study. Students who choose to defer entry may be admitted the following year subject to approval by the UoD. UoD will review applications of candidates selected by NFU and may interview candidates: the final decision regarding admission to the relevant programme is at the discretion of the UoD programme selectors.
Course Management Committee
5. A co-operation management committee will be established to manage the development and operation of the proposed articulation arrangement. Membership will comprise the following:
a. From the University of Dundee – Dr Janet Hughes, Link Co-ordinator, Head of Learning and Teaching, School of Computing; Prof. Peter Gregor, Dean of School of Computing; Ms Louisa Cross, School Secretary, School of Computing.
b. From NFU University – Prof. Yunfei Liu, Dean of College of Information Science and Technology; Dr. Ning Ye, Vice dean of College of Information Science and Technology; Associate Prof. Yu Zhou, Vice dean of Department of Computer Science and Engineering.
6. The parties will approve a list of UoD modules that NFU would accept as credits towards the NFU bachelor degree.
General responsibilities of both parties
7. Each party will co-operate in a spirit that is open and transparent.
8. Each party will only be liable for its own acts and omissions.
9. Each party will be responsible for complying with all applicable statutory, legislative, regulatory, financial and all other legal and related requirements and also any liabilities pertaining to its own operational, student-related and other obligations under this agreement.
10. Each party shall have conduct of disputes and/or litigation arising from its own acts or omissions, for which it shall be liable.
11. Each party shall indemnify the other against liabilities arising for matters within its own control.
12. Each party is required to act only within its powers and constitution and each shall solely be liable for any breach of this requirement.
Provision of information
13. Each party will maintain proper records relating to its responsibilities and obligations under this agreement.
14. Each party will provide information necessary, and as requested by the other to enable the effective operation and development of the collaboration.
15. Each party will treat information provided by the other as confidential and will not divulge it to any third party without the prior approval of the other party to this agreement.
Communication and co-ordination
16. Each party will designate a member of its staff as Link Co-ordinator. Each Link Co-ordinator will:
a. Be the formal point of contact between the two parties
b. Be required, and authorised to consult, report and seek approvals of the relevant bodies or office holders within their organisation on all matters associated with the collaboration.
c. Provide prompt responses to all communications received from the other Link Co-ordinator.
17. Either party may change its designated Link Co-ordinator. Any such change should be communicated to the other party’s Link Co-ordinator in advance of the change taking effect.
Financial arrangements
18. Neither party may incur, commit or authorise financial expenditure on behalf of the other.
19. Each party will be responsible for its own costs associated with any activities relating to this agreement. The fees per student will be based on the UoD's standard fees charged to international students. Details about all financial arrangements associated with this Articulation Agreement for this Programme will be covered in Annex 2.
Intellectual property considerations
20. All background intellectual property being intellectual property in existence prior to the agreement and owned by a party to the agreement shall remain the property of that party and shall not be used other than for the purposes of the agreement without the express permission of the owning party. Provided that all such background intellectual property will be treated in strictest confidence by all recipients thereto.
21. All foreground intellectual property being intellectual property that arises from work undertaken under the agreement shall be owned by the party or parties who can claim a direct intellectual input to the resultant technology, design or copyright work.
Publicity and promotional material
22. Neither party may use the institutional name or logo of the other without prior written approval. Such approval will require submission of draft copy and a listing of proposed destinations of the publicity. If the proposed publicity is not in the English language, an authorised translation shall be provided. Within the UoD the Link Co-ordinator will consult with the Secretary to the University regarding such approval.
Legal jurisdiction
23. Both parties agree that the Law of Scotland applies to activities within
Period of validity of the agreement
24. This agreement will be valid for a period of three years from date of first signature.
25. The effectiveness of the collaboration will be reviewed by both parties no later than 12 months prior to the scheduled expiry date.
26. The collaboration may be extended or renewed by mutual agreement following the review.
Termination and disputes
27. Either party may terminate this agreement by registered letter giving 12 (twelve) months notice. Following receipt of such notice the termination process would be planned in ways that take account of the concerns and situation of the students who had commenced their studies at UoD.
28. Should any dispute arise relating to this collaboration the respective Link Co-ordinators will attempt to seek resolution acceptable to their organisation. Should the Link Co-ordinators fail to achieve resolution, the Principal of the UoD and the President of XX will nominate individuals or parties who will be empowered to seek a resolution.

Annex 2: Financial details
1. The student fee is based on the UoD’s standard tuition fee for international students. There will be a scholarship for students from NFU under this agreement. The student fee arrangement is:
(a) Students admitted to the programme will pay a specially fee (bench fee) of 4,000 GBP to cover the first year (4th year of the BSc degree).
(b) Students who meet the requirement and progress to Master level will be offered a School of Computing Scholarship of 4,000 GBP
2. The University of Dundee will provide further support for this programme, which includes:
(a) A further special Dean’s Scholarship of £2000 to be awarded to excellent students who achieve a minimum average mark of 70% for the School of Computing, in the examinations of part A course at UoD, this sum being deducted from the tuition fee when the qualifying student matriculates onto the MSc course in Part B.
(b) An articulation development fund will be established within the School of Computing at UoD. Each year a sum of money equal to £200 x number of enrolled students will be donated. This fund will be used to help support staff exchanges between the two universities.
3. Neither party may incur, commit or authorise financial expenditure on behalf of the other.
4. Each party will be responsible for its own costs associated with any activities relating to this agreement.
5. This financial agreement will be valid for three academic years starting from September 2010, which applies to students matriculating in Dundee in September 2010, 2011 and 2012. The tuition fee of the Master year will be based on the standard international student fee.
6. This agreement will be reviewed/renewed for a period of three years from the date of first signature, by both parties no later than 6 months prior to the scheduled expiry date.
7. This financial agreement will be invalid when the Articulation Agreement is terminated. More information about the Termination and disputes can be found in the Articulation Agreement.
